Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Capture Rig ("the service"). By creating an account or using the service, you agree to these Terms.

Your account

You are responsible for keeping your login credentials secure and for all activity that happens under your account. You must provide accurate information and keep it up to date.

Subscription and billing

  • The service is offered for $29.99 per month, which includes two brands.
  • Each additional brand is $10 per month, billed alongside your subscription.
  • Crew Access is an optional add-on at $10 per month. It unlocks 5 additional shooting sessions and lets you invite crew members under assistant or guest roles. The add-on renews alongside your subscription and can be removed at any time; removing it revokes crew members' access to your studio.
  • Subscriptions and add-ons renew automatically until you pause, cancel, or remove them.
  • You may pause or cancel at any time. Your data stays in place when you return.

Refunds and cancellation

  • You may cancel your subscription, or remove add-ons such as extra brands and Crew Access, at any time from your account settings. Cancellation and removals take effect at the end of your current billing period, and you retain access until then.
  • Subscription and add-on fees are billed in advance and are non-refundable, except where required by applicable law. We do not provide prorated refunds for partial billing periods.
  • If you believe you were charged in error, contact us within 30 days at support@thecapturerig.com and we will review your request in good faith.

Subscription agreement and billing consent

By creating an account, starting a trial, subscribing, or using paid features, you agree to these Terms of Service and to our Privacy Policy.

By subscribing, you authorize The Capture Rig or its payment processor to charge your selected payment method for subscription fees, taxes, add-ons, storage upgrades, overages, and other charges associated with your account.

Subscription fees are billed in advance and are non-refundable except where required by law or expressly stated by The Capture Rig in writing. You may cancel your subscription through the available account or billing controls. Cancellation stops future billing but does not automatically refund prior charges.

Storage limits and file uploads

The standard subscription plan includes 200 GB of gallery storage for client-ready files, unless a different storage amount is shown in your account, on the checkout page, or in your plan details.

Client-ready uploads may be limited by file size, file type, format, resolution, or other technical restrictions. The standard upload limit is up to 25 MB per file unless otherwise stated in your account or plan details.

The Capture Rig may restrict unsupported or inappropriate file types, including but not limited to RAW files, TIFF files, PSD or PSB files, ZIP or compressed archives, executable files, system files, and video files, unless expressly supported by your plan or an add-on.

Intended storage use

The Capture Rig storage is intended for active photography workflows, delivered galleries, client-ready images, intake assets, project materials, brand assets, proofs, and long-term client reference related to a photography or creative business.

The Capture Rig is not intended to be used as a primary or sole backup system, RAW photo archive, full studio repository, video library, file mirror, file-sharing service, unrelated document storage system, or general-purpose cloud drive.

You are responsible for maintaining independent backups of all files, images, client data, and business records. The Capture Rig is not responsible for loss of content, business interruption, missed delivery, or failure by you to maintain your own backups.

Exceeding storage limits

If an account exceeds the storage included with its plan, The Capture Rig may notify you and provide options to reduce storage, delete files, archive inactive content, purchase additional storage, upgrade the subscription, or move to a custom storage arrangement.

If you do not take action after notice, The Capture Rig may restrict additional uploads, limit access to storage-heavy features, disable downloads, archive inactive galleries, or suspend portions of the service until the issue is resolved.

The Capture Rig reserves the right to take immediate action without prior notice if usage is abusive, harmful to platform performance, creates a security risk, violates these Terms, or uses the service in a way that is materially different from its intended purpose.

Storage add-ons

Additional storage may be available as a paid add-on. Storage add-ons are billed according to the pricing shown at the time of purchase.

Storage add-ons increase available gallery storage but do not change the intended purpose of the platform. Even with additional storage, The Capture Rig may not be used as a RAW archive, full backup system, video hosting platform, or general-purpose cloud storage service unless expressly agreed in writing.

Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or in violation of any applicable law.
  • Upload content you do not have the right to use, or that infringes the rights of others.
  • Attempt to disrupt, reverse engineer, or gain unauthorized access to the service.
  • Use the service to send spam or harvest data without consent.

User content ownership

You retain ownership of the images, files, logos, text, client information, and other content you upload to The Capture Rig.

By uploading content, you grant The Capture Rig a limited license to host, store, process, display, transmit, resize, optimize, back up, and otherwise use the content solely as needed to provide the platform and related services to you and your clients.

You represent that you have the rights, permissions, releases, and authority necessary to upload and use the content through the platform.

Crew members

With Crew Access you can invite crew members (assistants or guests) who each sign in with their own login. You are responsible for the people you invite and for their use of the service. Crew access is controlled by you and can be revoked at any time. Crew members can use the tools they need for a shoot but cannot see your financials, payout details, or account settings, which remain visible to the account owner only.

International availability

The Capture Rig is offered to studios in the European Union, the United Kingdom, Latin America, and other regions. You are responsible for complying with the laws that apply to you, including obtaining any consents required from your own clients and crew, when you use the service in your jurisdiction.

Artificial intelligence (AI) features

The Capture Rig may offer features powered by artificial intelligence. In relation to these features, The Capture Rig acts as a deployer of AI systems, not a provider of them, within the meaning of the EU AI Act (Regulation (EU) 2024/1689). Any AI capabilities are powered by third-party AI providers, who remain responsible for the underlying models. These terms apply whenever AI features are enabled on your account.

  • Third-party providers. When AI features are enabled, the content you submit may be processed by third-party AI providers solely to deliver the requested functionality. Those providers' own terms apply to that processing, and we work to select providers that offer appropriate technical and contractual safeguards.
  • Your responsibilities. You are responsible for how you use AI outputs, for reviewing them before relying on them, and for not submitting content you do not have the rights or consents to process - including obtaining any consent required from your clients and crew.
  • No guarantees on output. AI-generated output may be inaccurate or incomplete and is provided "as is" without warranty. It does not constitute professional advice and should be reviewed by you before use.
  • Data protection. Any personal data processed through AI features is handled in line with applicable data-protection laws - including the EU and UK GDPR, Brazil's LGPD, and Mexico's LFPDPPP - and consistent with our Privacy Policy. You remain the controller of your clients' and crew's data, and we and our AI providers act as processors.
  • Prohibited uses. You may not use AI features for any unlawful, discriminatory, or prohibited practice under the EU AI Act or other applicable AI laws.

Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe content on the service infringes your copyright, send a notice to our designated agent at dmca@thecapturerig.com that includes:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material that is allegedly infringing, with enough detail to locate it.
  • Your contact information (name, address, email, and telephone number).
  • A statement that you have a good-faith belief the use is not authorized, and a statement, under penalty of perjury, that the information is accurate and you are authorized to act.
  • Your physical or electronic signature.

We will respond to valid notices in accordance with the Digital Millennium Copyright Act, and we may remove infringing content and terminate repeat infringers' accounts.

Payments to you

When clients pay for downloads, you keep 100% of your sales. The Capture Rig does not take a percentage of your sales. Payment processing is handled by our third-party payment provider, and their terms apply to those transactions.

Data retention

  • We retain your account and studio content for as long as your account is active so the service works as expected.
  • If you pause or cancel your subscription, your data remains available to you. You keep access to your account and content, and you can export or delete it at any time.
  • When you request permanent deletion of your account, we remove your account and associated content from active systems, except for the limited records described below.
  • We retain certain records for the periods required by the record-keeping, legal, tax, and accounting obligations that apply in the relevant jurisdiction, and as needed to resolve disputes and enforce our agreements. Retention periods vary by jurisdiction.
  • Backups are rotated on a regular schedule and any residual copies are overwritten in the ordinary course of operations.

Availability

We work hard to keep the service available and reliable, but we do not guarantee uninterrupted access. We may modify or discontinue features over time.

Lead Capture, Notifications, and Customer Responsibility

The Capture Rig may provide lead capture, gallery activity, download activity, inquiry tracking, email notifications, SMS notifications, push notifications, webhook delivery, third-party automation triggers, and related communication features. These features are provided as operational tools to help customers manage their business activity.

Customer acknowledges and agrees that the application dashboard and account records are the primary source of truth for leads, inquiries, gallery activity, download activity, and other customer-facing activity captured through the Services. Email, SMS, push, webhook, automation, and other notifications are provided as convenience features only and are not guaranteed delivery mechanisms.

The Capture Rig does not guarantee that notifications will be delivered, received, opened, read, or acted upon. Notification delivery may be affected by factors outside The Capture Rig's control, including but not limited to spam filters, email provider rules, incorrect email addresses, mailbox storage limits, customer device settings, internet connectivity, third-party service outages, authentication or domain configuration issues, webhook endpoint failures, automation platform errors, and customer system settings.

Customer is solely responsible for regularly accessing their account dashboard, reviewing captured leads and activity, maintaining accurate notification settings, confirming that email addresses and integrations are properly configured, monitoring spam or junk folders, and taking timely action on leads, inquiries, downloads, orders, bookings, or other business opportunities.

The Capture Rig shall not be responsible or liable for any lost leads, missed inquiries, lost bookings, lost sales, lost revenue, lost profits, loss of business opportunity, reputational harm, customer dissatisfaction, or other damages arising from or related to delayed, failed, blocked, filtered, misdirected, unread, or undelivered notifications, provided that the relevant lead, inquiry, download, activity record, or other captured information was available within the customer's account dashboard or system of record.

Customer agrees that use of the Services requires active account monitoring and that notification features are not a substitute for logging into the platform and reviewing account activity.

Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, The Capture Rig and its owners, officers, employees, contractors, affiliates, service providers, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, including but not limited to lost profits, lost revenue, lost sales, lost bookings, lost leads, loss of goodwill, loss of business opportunity, business interruption, reputational harm, or the cost of substitute services, whether arising under contract, tort, negligence, strict liability, or any other legal theory, even if The Capture Rig has been advised of the possibility of such damages.

To the maximum extent permitted by law, The Capture Rig's total aggregate liability for any claim arising out of or relating to the Services shall not exceed the amount paid by the customer to The Capture Rig for the Services during the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

The limitations in this section apply regardless of the form of action and survive termination or expiration of the customer's account or subscription.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you. Continued use of the service after changes take effect constitutes acceptance.
